LISBON, Ohio (WYTV) — A Lisbon man convicted of driving intoxicated with his 2-year-old son in the vehicle was sentenced to 100 days in jail.
The Morning Journal reports that Homer Carnes, 36, pleaded no contest to child endangering, OVI first offense, unauthorized plate and speeding. He was also charged with obstructing official business for reportedly lying to police about a previous assault at a Grant Street home.
According to court records, Carnes was driving 100 mph in a 55 mph zone on state Route 154 in Elkrun Township when stopped by a highway patrol trooper, who determined he had been drinking. In the back seat was Carnes’ 2-year-old son.
Carnes was also fined $1,350, had his license suspended for six months and is required to perform 60 hours of community service.
Prosecutors suggested Carnes have no contact with his child, but defense attorney Robert Bricker said this would be a problem because Carnes currently has custody of his children while the mother is spending time in a halfway house.
Children Services is reportedly involved.
